This Website is operated by a fine artist based in Alberta, Canada, selling original artwork, fine art prints, and commissioned works.

You agree to use this Website for lawful purposes only. You may not use the Website in any way that violates applicable laws or infringes on the rights of the artist or others.

3. Intellectual Property & Copyright

Ownership of Artwork

All artwork, designs, images, text, and content on this Website are the exclusive intellectual property of Marine Aimée Schoeman, unless explicitly stated otherwise.

This includes:

  • Original paintings

  • Prints created from original artwork

  • Commissioned artwork

  • Website images and descriptions

All artwork is protected under Canadian copyright law and international copyright agreements.

What Buyers Do Not Receive

Unless explicitly stated in writing, buyers do not receive:

  • Copyright ownership

  • Licensing rights

  • Rights to reproduce, copy, scan, digitize, or recreate the artwork

  • Rights to resell the artwork as merchandise, prints, NFTs, or digital files

4. Original Artwork Purchases

When you purchase an original painting:

  • You receive ownership of the physical artwork only

  • The artist retains all copyright and reproduction rights

Prints from Originals

By purchasing an original painting, you agree that:

  • The artist may create and sell prints or reproductions of the artwork

  • The artist retains full rights to the design, image, and composition

  • No exclusivity is granted unless explicitly agreed to in writing

5. Fine Art Prints

All prints sold are reproductions of original, one-of-a-kind artworks created by the artist.

Purchasing a print:

  • Does not transfer copyright or licensing rights

  • Does not permit reproduction, resale, or commercial use

Prints are for personal display only, unless otherwise stated in writing.

6. Commissions and Custom Artwork

Commissioned artwork is created specifically for the client based on agreed-upon details.

  • A non-refundable deposit may be required before work begins

  • Final payment is required before delivery

  • All timelines are estimates and may change due to creative or practical factors

Rights to Commissioned Work

Unless explicitly agreed in writing:

  • The artist retains all copyright and reproduction rights

  • The artist may display the work in portfolios, on the Website, or on social media

  • The artwork may be reproduced as prints unless otherwise stated

7. Pricing, Currency, and Taxes

  • All prices are listed in Canadian Dollars (CAD)

  • Prices do not include applicable taxes unless stated

  • Applicable taxes (such as GST) will be applied at checkout

Customers are responsible for any customs duties or import taxes for international orders.

8. Payment Processing

Payments are processed securely through Squarespace’s built-in payment processing (Squarespace Payments).

9. Shipping and Delivery

  • Shipping costs are calculated at checkout

  • Delivery times are estimates only

  • Risk of loss transfers to the buyer once the artwork is handed to the carrier, except where prohibited by law

We are not responsible for delays caused by shipping carriers or customs.

10. Returns and Refunds

Please refer to our Refund Policy for full details. By making a purchase, you agree to that policy.

11. Accuracy of Information

We make reasonable efforts to display artwork accurately, but:

  • Colours may vary depending on screens and devices

  • Minor variations in prints may occur

We reserve the right to correct errors at any time.

12. Limitation of Liability

To the fullest extent permitted by law, Marine-Aimée Schoeman is not liable for any indirect or consequential damages arising from the use of this Website or the purchase of artwork.

Nothing in these Terms limits your rights under Canadian consumer protection laws.

13. Governing Law

These Terms are governed by the laws of Alberta, Canada, and the applicable federal laws of Canada.
